Our Family Lives: Terms and Conditions of Service

Here's what you'll find reading our Terms of Service:

What we will do – make our service the best it can be and protect your personal information
What we might do – actually bring you closer together with others
What we won't do – give away any personal information about you, your family, or anyone you know that is shared with us
What we expect of you – please do not use or make a purchase from our Service if you do not agree to these terms

In no way should this summary serve as a substitute for the information on the following pages. Please read it and keep a copy for reference.

1. Agreement.
This agreement (the "Agreement") is entered into by and between you and the Company, Our Family Lives LLC ("OFL") regarding your use of OurFamilyLives.com website and the Our Family Lives web application Service, mobile application or associated products. By using OFL, you are entering into this Agreement with OFL and indicating that you agree to be bound by these terms and conditions. If you do not agree with these terms and conditions, please do not use the Service.

You agree to all of the following if you choose to use or make a purchase from OFL.

2. Proper Use.
You agree that you will use the Service in compliance with all applicable local, state, national, and international laws, rules and regulations. You shall not, shall not agree to, and shall not authorize or encourage any third party to: (a) use the service to harass other users; (b) prevent others from using the Service; (c) use the Service for any fraudulent or inappropriate purpose. Any violation of the above may result in immediate termination of this Agreement, and may subject you to state and federal penalties and other legal consequences. OFL reserves the right, but shall have no obligation, to investigate your use of the Service in order to determine whether a violation of the Agreement has occurred or to comply with any applicable law, regulation, legal process or governmental request.

3. Personal Use.
The Service is made available to you and your participants for your personal use only. You must provide current, accurate identification, contact, and other information that may be required as part of the purchase or registration process and/or continued use of the Service. You are responsible for maintaining the confidentiality of your Service password and account, and are responsible for all activities that occur thereunder. You may only display the content of the Service for your own personal use (i.e., non-commercial use) and may not otherwise copy, reproduce, alter, modify, create derivative works, or publicly display any content, without the prior written permission of OFL.

4. Purchase of a Family Subscription to Our Family Lives
The Service is currently available to purchase as a Family Subscription. Payment for a Family Subscription is either pre-paid on an annual monthly basis. As the purchaser, you are responsible for specifying who is included in your family and who has access to your Subscription account. By completing the order process form, you acknowledge you are solely responsible for the accuracy of the information you provide which includes family member emails. As of August 18, 2014, the purchase price for an annual family Subscription is $60 (USD) if prepaid in full or $5.95 per month (USD), pre-paid for the month that follows. A 30-day free trial period is included with both payment plans.

5. Automatic Subscription Renewals and Recurring Payments
Your Family Subscription renews automatically along with a recurring payment unless you choose to cancel your Subscription (see #7. For a pre-paid Annual Subscription, you will be notified via email about the auto-renewal 30 days prior to your Subscription’s expiration date. For a monthly payment Subscription, your plan will automatically renew each month unless you decide to cancel.

6. Submitted Content: Digital Media Objects
OFL does not claim ownership of any materials, digital media objects or referenced digital objects that you make available through the Service or used in your OFL account. We take no responsibility and assume no liability for any digital media objects added, created, and posted in your OFL account. If you do not agree to these terms and conditions, please do not make a purchase. You agree that you and the participants in your Family Subscription are fully responsible for the content submitted. You are prohibited from posting or transmitting to or from this Service: (i) any unlawful, threatening, libelous, defamatory, obscene, pornographic, or other material or content that would violate rights of publicity and/or privacy or that would violate any law; (ii) any commercial material or content (including, but not limited to, solicitation of funds, advertising, or marketing of any good or services); and (iii) any material or content that infringes, misappropriates or violates any copyright, trademark, patent right or other proprietary right of any third party. You shall be solely liable for any damages resulting from any violation of the foregoing restrictions, or any other harm resulting from your posting of content using the Service.

You own all content on your OFL content and take full responsibility for all of the digital media objects used in your OFL account.

7. Subscription Cancellation, Refunds, and Return of Digital Media Objects
You may cancel your Subscription at any time by contacting us via email using the primary email address associated with your OFL Subscription. Any unused portion of a pre-paid annual Family Subscription will be refunded based on a pro-rata basis. There is no refund however for the monthly Family Subscription plan. If you do decide to cancel, all digital media objects that are stored on the OFL server will be returned to you within five (5) business days. All digital media objects will be returned as is. Note, all corresponding groups and associations between your digital media objects will no longer be linked.

Your Subscription auto-renews unless you tell us otherwise. We will return your digital media objects stored on our server.

8. Children's Online Privacy.
Due to the Children's Online Privacy Protection Act of 1998, you must be at least thirteen (13) years of age to use this Service.

You are old enough to use Facebook, even if you no longer use or like Facebook.

9. User Representations and Warranties.
You represent and warrant that (a) all of the information provided by you to make a purchase or participate in the Service is correct and current; (b) you have all necessary right, power and authority to enter into this Agreement and to perform the acts required of you hereunder.

10. Access To Password Protected/Secure Areas
Access to and use of password protected and/or secure areas of the Service is restricted to authorized users only. Unauthorized individuals attempting to access these areas of the Service may be subject to prosecution.

11. Refusal of Service; Termination; Suspension.
OFL reserves the right in its sole discretion to refuse, suspend, or terminate the Service to anyone at any time without notice for any reason.

12. Privacy.
As a condition to using the Service, you agree to the terms of the OFL Privacy Policy as it may be updated from time to time. We understand that privacy is important to you just like it is to us. You do, however, agree that the Company may monitor, edit or disclose your personal information, including the content of your emails, only if required to do so in order to comply with any valid legal process or governmental request (such as a search warrant, subpoena, statute, or court order), or as otherwise provided in these Terms of Service and the OFL Privacy Policy.

13. Warranty.
OFL does not represent that the Service is reliable, accurate, complete, or otherwise valid. THE SERVICE IS PROVIDED "AS IS" WITH NO WARRANTY OF ANY KIND AND YOU USE THE SERVICE AT YOUR OWN RISK. OFL EXPRESSLY DISCLAIMS ANY WARRANTY, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. UNDER NO CIRCUMSTANCES WILL OFL BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH USE OF THE SERVICE WHETHER OR NOT YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES SHALL OFL BE LIABLE TO YOU FOR ANY AMOUNT FOR SERVICES RENDERED PURSUANT TO THIS AGREEMENT.

14. Indemnification.
You agree to hold harmless and indemnify the Company (OFL), and its employees, agents and representatives, from and against any third party claim arising from or in any way related to your use of the Service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature.

15. Electronic Communication.
When you use the Service or send emails to OFL, you are communicating with OFL electronically. You consent to receive communications from OFL electronically. OFL will communicate with you by email or by posting notices on the Service. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

16. Links.

17. Liability.
To the maximum extent permitted by applicable law, you hereby release, and waive all claims against OFL and its employees and agents from any and all liability for claims, damages (actual and consequential), costs and expenses (including litigation costs and attorneys' fees) of every kind and nature, arising out of or in any way connected with use of the Service.

18. Trademarks
The trademarks, logos and service marks (“Marks”) displayed on the Site are the property of Our Family Lives LLC. Users are prohibited from using any Marks for any purpose including, but not limited to use as metatags on other pages or websites without the written permission of Our Family Lives LLC. All information and content including any software programs available on or through the Site (“Content”) is protected by copyright. Users are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any Content available on or through the Site for commercial or public purposes.

20. Procedure for Claims of Intellectual Property Infringement
OFL respects the intellectual property of others, and we ask our users to do the same. OFL may, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who may be infringing the intellectual property of a third party. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide OFL’s Copyright Agent the following information: (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest; (ii) a description of the copyrighted work or other intellectual property that you claim has been infringed; (iii) a description of where the material that you claim is infringing is located on the Service; (iv) your address, telephone number, and email address; (v) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; or (vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.

21. Modifications to the Agreement.
The Company (OFL) shall have the right to modify the terms of this Agreement at any time. The new agreement shall be effective immediately.

22. General.
Notwithstanding any other provisions of this Agreement, or any general legal principles to the contrary, any provision of this Agreement that imposes or contemplates continuing obligations on a party will survive the expiration or termination of this Agreement.
If any of these conditions are deemed invalid, void, or for any reason unenforceable, the parties agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the unenforceable condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition. Headings are for reference purposes only and do not limit the scope or extent of such section.
This Agreement and the relationship between you and OFL will be governed by the laws of the State of California without regard to its conflict of law provisions. You and OFL agree to submit to binding arbitration located in San Francisco, California and adhering to the arbitration standards of the State of California with respect to any legal proceedings that may arise in connection with this Agreement. The failure of OFL to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. OFL does not guarantee it will take action against all breaches of this Agreement. Except as otherwise expressly provided in this Agreement, there shall be no third-party beneficiaries to this Agreement. This Agreement constitutes the entire Agreement between you and OFL and governs your use of the Site and Service superseding any prior agreements between you and OFL with respect to the Service.
